IMPORTANT: You MUST own all rights to artwork you submit or have proper licenses/permissions to use it. We are not responsible for verifying copyright ownership.
By submitting an order with Mux786llc, you represent and warrant that:
- You are the legal owner of all intellectual property rights in the designs, artwork, logos, text, and other materials you provide to us, OR
- You have obtained all necessary licenses, permissions, and authorizations to use such materials for the intended purpose
- Your use of such materials does not infringe upon any third party's copyrights, trademarks, patents, or other intellectual property rights
- You will not submit any designs featuring copyrighted characters, trademarked logos, or protected intellectual property without proper authorization (examples include: Disney characters, Marvel/DC comics, sports team logos, brand logos, celebrity images, etc.)
2. Customer Indemnification
You agree to indemnify, defend, and hold harmless Mux786llc, its owners, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to:
- Any infringement or alleged infringement of intellectual property rights related to materials you provide
- Any violation of these Terms of Service
- Your use of our services
- Any claims brought by third parties regarding the products we produce for you
3. Amazon FBA Compliance
Amazon Account Risk: Amazon actively monitors and enforces intellectual property rights. Selling products that infringe on copyrights or trademarks can result in:
- Immediate listing removal
- Account suspension or permanent ban
- Inventory seizure or destruction
- Legal action from rights holders
- Withheld funds or payment delays
Mux786llc is NOT responsible for any consequences to your Amazon seller account resulting from intellectual property violations in designs you provide to us.
4. Refusal of Service
We reserve the right to refuse service for any order that:
- Contains obvious trademark or copyright violations (branded characters, logos, etc.)
- Could expose us or you to legal liability
- Violates applicable laws or regulations
- Contains inappropriate, offensive, or illegal content
5. Custom Orders Only
We operate on a custom order basis. All orders are produced specifically for each customer based on their provided specifications. We do not maintain stock inventory or offer pre-made designs.
6. Pricing & Payment
- All prices are quoted based on your specific requirements and are subject to change
- Payment terms will be specified in your quote
- Production begins only after payment is received and artwork is approved
- Rush orders may incur additional fees
7. Production & Delivery Timeline
- Production timelines are estimates and may vary based on order complexity and volume
- We will provide tracking information for all FBA shipments
- Delays caused by incorrect FBA addresses or Amazon warehouse issues are not our responsibility
8. Quality & Defects
- We guarantee high-quality production standards
- If you receive defective products due to our manufacturing error, we will replace them at no charge
- Claims must be made within 7 days of receipt
- We are not responsible for design errors in artwork you provide
9. Cancellations & Refunds
- Orders can be cancelled before production begins for a full refund
- Once production has started, cancellations may incur fees for work completed
- Completed orders are non-refundable except in cases of manufacturing defects
10. Limitation of Liability
Mux786llc's liability is limited to the amount you paid for the specific order in question. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits or revenue
- Amazon account suspensions or bans
- Legal fees or settlements related to intellectual property claims
- Damage to business reputation
